2yourmatch.com Terms of Use Agreement
[Applicable for all users and members]

By using 2yourmatch.com Website (“Website”) or any of our service/s (“Service ”) operated by Agston you agree to all of the terms and conditions (“Agreement”), whether or not you join, register or subscribe as a member (“Member”). You further affirm your acceptance of this Agreement and its terms and conditions by becoming a Member of the Website and/or Service.

As used in this Agreement, “our”, “we”, “us”, “2yourmatch.com” means 2yourmatch.com and/or Agston.

These terms and conditions will survive Membership and/or Use of the Website and/or Service.

(a)Eligibility

By becoming our Member or by using the Website and/or Service:

-you represent, warrant and covenant that you are at least 18 years old
-you represent and warrant that you have the authority, capacity and right to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

(b)Right to Use

Your right to use the Website and/or Service is subject to any restrictions, limitations and conditions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Website and/or Service at any time, including the availability of any Website and/or Service feature, database or content. We may also impose limits on certain features and aspects of the Website and/or Service or restrict your access to parts or all of the Website and/or Service without any notice or liability. We may change any prices or fees including Membership or Subscription fees for using the Website and/or Service, at any time in our sole discretion.

(c)Modifications

This Agreement sets out the legally binding terms and conditions for the Member and/or User of the Website and/or Service and may be modified by 2yourmatch.com from time to time, such modifications to be effective upon posting by 2yourmatch.com on the Website. If you do not agree to any modifications, you should terminate your use of the Website and Service. Your continued use of the Website and/or Service now, or following the posting of the modifications in this Agreement, will constitute a binding acceptance by you of this Agreement, or any subsequent modifications.

(d)Terms of Conduct

You acknowledge and agree to use the Website and/or the Service in accordance with the following Terms of Conduct:

(I)you shall not use the Website and/or the Service to engage in any form of harassment, offensive behavior or post any content, information or material which contain, including but not limited to, slanderous, libelous, misleading, unlawful, fraudulent or untruthful, instigating, threatening, abusive, defamatory, racist, prejudiced, fanatic, pornographic, obscene or any other offensive content or any content promoting or providing information on illegal activities or conduct.

(II)you shall not transmit or forward chain letters or junk email or engage in any form of unsolicited mass mailing or spamming through the Website and/or the Service to other Members, Users of the Website and/or Service or to any other.

(III)you shall not use the Website and/or the Service for any advertising, solicitation or for any other commercial purposes. To protect our Members and Users from such advertisements and solicitations 2yourmatch.com reserves the right to restrict or limit the number of emails which you or any other Member may send to other Members or Users to a certain number, within any 24-hour-period, which we deem appropriate in our sole discretion.

(IV)you shall not include, any content or material that contains hidden pages, information, links or images or any restricted or password-protected or password-access pages.

(V)you shall not use the Website and/or the Service to infringe or violate the privacy, copyright or property rights or any other rights of any person or any third party. You shall not post or transmit any content or material or use the Website and/or the Service in any manner that infringes, violates or plagiarizes upon the rights of any person or third party, including but not limited to any trademark, privacy, copyright or any other proprietary or personal rights.

(VI)you shall not use the Website and/or the Service to transmit, distribute or upload any disruptive or interruptive programs, computer viruses, or do anything that may cause damage, loss or harm to the Website and/or the Service or to any of the Members or Users of the Website or the Service.

(VII) you shall not include, post or transmit in any manner, through your publicly posted information, any contact information including, but not limited to, email addresses, telephone numbers, mailing addresses, full names, URLs or instant messenger particulars.

(VIII)you shall keep your Membership or account information private. You shall be responsible for all, including but not limited to, the usage, communication, interaction, transaction, financial transaction, transmission, posting of content, materials, information, by others, any third party or anyone using your username and password

(IX)you must use the Website and/or the Service in a manner consistent with any and all applicable laws and regulations.

(e)Content Posted

(I)you agree, acknowledge and understand that 2yourmatch.com though not responsible may monitor, review and/or delete any, including but not limited to, content, material, information, profiles or profile particulars, photos, video or audio recordings, messages, that in the sole judgment or decision of 2yourmatch.com violate this Agreement or that which might be illegal, offensive, violate the rights, harm or threaten the safety of the Members or Users.

(II)you agree you are solely responsible for any content, material or information that you post, publish, transmit or display on or via the Website and/or the Service for or to the other Members or Users.

(III)by posting any content, material or information to any public area of 2yourmatch.com, you automatically grant, and you represent and warrant that you have the right to grant, to 2yourmatch.com an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

(f) Member and/or User Disputes

2yourmatch.com has no obligation, but reserves the right to monitor disputes between you and other Members and/or Users. You acknowledge you are solely responsible and accountable for your communications and interactions with other 2yourmatch.com Members and/or Users.

(g)Termination or suspension

2yourmatch.com may terminate or suspend your 2yourmatch.com Membership or Subscription at any time, for any reason, without any explanation, effective upon sending written or email notice to you. 2yourmatch.com reserves the right to immediately suspend or terminate your access to the 2yourmatch.com Service and/or Website, without any notice, upon any breach of this Agreement by you which is brought to 2yourmatch.com’s attention. Membership/Subscription fees are not refundable. However, should there be disputes relating to the Membership/Subscription fees , refund may be given at the sole discretion of 2yourmatch.com’s management. If you would like to request for a refund you shall address the request to 2yourmatch.com first, by sending an email to support@2yourmatch.com with all the necessary and complete details clearly written.

(h)Privacy

We reserve the right to email you, for the purpose of informing you of changes or additions to the Website and/or the Service or of any 2yourmatch.com related products and services/Service. We reserve the right to disclose information about your usage of the Website and/or the Service and demographics in forms that do not reveal your personal identity.

Use of the Website and/or the Service is also governed by our Privacy Policy.

(i)Non commercial usage

The Website is for your sole, individual, personal use and shall not be used in connection with any commercial intention or purpose. You shall not authorize others to use your membership or account, and you shall not transfer or assign your membership or account to any other person or entity. Companies, businesses, organizations or any other commercial entities shall not use the Website, Service or become members for any purpose, unless specifically authorized by us in writing. Unauthorized, unlawful or illegal uses of the Website and/or Service, including collecting information, particulars, usernames, email addresses, any data, information, material, etc by electronic or any other means for any purpose including sending of unsolicited email may lead to appropriate legal action being taken.

(j)Proprietary Content/s at 2yourmatch.com

The Website may contain/contains trademarks, copyrighted materials, and other proprietary information of 2yourmatch.com, our partners, affiliates, subsidiaries, licensors or Members and/or Users. You agree not to modify, copy, distribute, transmit, disseminate, publish, display, perform or sell any such proprietary information in any manner whatsoever without having first received the written permission of the owner of such information.

(k)Copyright

You shall not post, copy, reproduce, disseminate or distribute in any manner any trademarks, copyrighted information, materials, or any other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Website and/or the Service in a way that constitutes copyright infringement, you shall inform us first, by emailing the necessary and complete details to copyright@2yourmatch.com .

(l)Disputes

If there is any dispute about or involving the Website and/or the Service, by using the Website and/or the Service, you agree that the laws of the Republic of Singapore will govern the dispute. You agree to jurisdiction by the courts sitting in the Republic of Singapore .

(m)Indemnity

You agree to indemnify and hold 2yourmatch.com, our representatives, partners, subsidiaries, affiliates, officers, agents and employees harmless from any liability, loss, damages, claim, or demand, including without limitation reasonable legal fees, which we may suffer due to or arising out of your activities on the Website or by your use of the Service, including without limitation any breach by you of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or any charges or complaints made by other parties against you.

(n)Disclaimers

The Website and the Service are provided on an "as is" basis and 2yourmatch.com grants no warranties of any kind whatsoever either expressed or implied.

2yourmatch.com expressly disclaims any warranties of merchantability, fitness for a particular purpose or non-infringement.

2yourmatch.com does not warrant that your use of the Website and/or Service will be secure, error-free, uninterrupted, always available, or that any defects in the Website and/or Service will be corrected.

2yourmatch.com will not be responsible, for any delays, omissions, interruptions, errors, defects, deletions, in the availability, connectivity, transmission, functioning, content or materials of the Website and/or the Service or for any unauthorized access, usage or modification.

2yourmatch.com is not responsible for any technical problems, errors or malfunctions or any including but not limited to damage to Members and/or Users of the Website and/or Service resulting from the involvement, participation, downloading, or usage of or from the Website and/or Service.

2yourmatch.com is not responsible for any inaccurate, fraudulent, erroneous or incorrect Member profile, information or content posted on the Website and/or Service, whether caused by Members or Users of the Website and/or the Service or by any technical problems, errors or malfunctions of the Website and/or Service. You acknowledge that any reliance upon any such information or content shall be at your sole risk. 2yourmatch.com is not responsible for the conduct of any Member and/or User of the Website and/or the Service, whether online or offline.

2yourmatch.com is not responsible for the suspension of any Service or any Website features or functionalities regardless of the cause of the suspension or interruption.

2yourmatch.com will not be responsible for any loss or damage, including personal injury, damages, grievances or death, resulting from anyone's use of the Website, the Service and/or any content posted on the Website and/or Service or transmitted to any Users and/or Members or due to any communications, exchanges or interactions between Members and/or Users of the Website and/or the Service, whether online or offline. You acknowledge that the use of the Website and/or Service is at your own risk.

2yourmatch.com cannot guarantee and does not promise any specific results from use of the Website and/or the Service unless expressly and clearly stated by 2yourmatch.com in writing.

You acknowledge and agree that we are not responsible for and have no liability as a result of the availability of the links to Other Site Links or their contents. You acknowledge and agree that the responsibility lies in you when or for using Other Site Links.

The Website and/or Service may contain advice, tips, opinions, feedbacks, suggestions, information, statements, materials or messages (collectively, “Advice”) from writers, journalists, columnists, others etc (collectively “Columnists”). (p)Complaints, Disputes and Others

You shall address any complaints, disputes and/or others alike to 2yourmatch.com first, by sending an email to support@2yourmatch.com with all the necessary and complete details clearly written.

(q) This Agreement contains the entire agreement between you and 2yourmatch.com regarding the use of the Website and/or the Service. If any provision of this Agreement is held invalid or unenforceable under applicable law, the remainder of this Agreement shall continue in full force and effect. Should any of the terms and/or conditions of this Agreement be found unenforceable or illegal as being too broad with respect to the duration, scope or subject matter thereof, such terms and/or conditions shall be deemed and construed to be reduced to the maximum duration, scope or subject matter allowable by law.
